Growing Green Sweepstakes Official Rules
Official Rules
The GreenChoice Bank Growing Green Sweepstakes (the “Sweepstakes”) is for legal residents of Illinois who are at least 18 years of age at the time of entry. The Sweepstakes and these Official Rules will be governed by Illinois law and applicable federal and local laws and regulations.
1. Sweepstakes Prizes
GRAND PRIZE: Custom-made sustainably-built table by Demeter Millwork (http://www.demetermillwork.com/), which includes labor and materials up to a maximum 25 square foot table top area.
SECOND PRIZE: Home energy audit by Sylvan Energy Consulting (http://www.sylvanec.com/), for a single family attached or detached residence of 4,000 square feet or less.
THIRD PRIZE: Your choice of a one-year individual regular membership to the U.S. Green Building Council, Illinois Chapter (http://www.usgbc-illinois.org/) or a $100 credit for I-GO Car Sharing (http://www.igocars.org/).
Total Approximate Retail Value of all prizes: $2,350
2. How to Enter
The Sweepstakes begins August 29, 2011 at 12:00AM Central Daylight Time ("CDT") and ends September 3, 2011 at 11:59PM CDT. Visit any GreenChoice Bank location during its regular business hours and fill out an entry form provided by a bank employee. No mechanical reproductions are permitted. All entries become the property of GreenChoice Bank and will not be returned.
New and current GreenChoice Bank customers will also receive one additional entry into the Sweepstakes when opening a new deposit account at any GreenChoice Bank location and making an opening deposit of at least $500 in cash or a check drawn upon a bank other than GreenChoice Bank. Any entry which is selected as a Potential Winner (as defined below) with an opening deposit that is returned or withdrawn leaving a balance less than $500 at the time the entry is selected shall be disqualified. New accounts are subject to customary account opening guidelines, and all deposits and accounts are also subject to the GreenChoice Bank Deposit Account Terms and Conditions Agreement posted at www.greenchoicebank.com/uploads/documents/termsandconditions.pdf. Limit four entries per person per day, but limit one entry for a new account opening per person per day and one entry per bank location visit per person per day.
3. Drawing
On September 9, 2011 at approximately 2:00PM CDT, an independent judging organization (the "Sweepstakes Judges") will randomly draw three entries (each, a “Potential Winner”) from among all eligible entries. The Potential Winners will be eligible to win the applicable Sweepstakes prize, subject to verification of compliance with the Official Rules.
4. Limitations on Eligibility
The Sweepstakes is open to legal residents of Illinois who are at least 18 years of age at the time of entry. Employees of GreenChoice Bank, its affiliates, its advertising and promotional agencies involved in the Sweepstakes, prize donors for the Sweepstakes, and their respective family members are not eligible to enter or win. The Sweepstakes and these Official Rules will be governed by Illinois law and applicable federal and local laws and regulations.
Entries generated by photocopy, printing, script, macro or other automated or mechanical means and entries by any means which subvert the entry process described above under “How to Enter” will be void. Please see the privacy policy located at http://www.greenchoicebank.com/uploads/documents/privacynotice.pdf for GreenChoice Bank's policy regarding the use of personal information collected in connection with the Sweepstakes.
5. Restrictions on Receipt of Prizes
Prizes are not transferable. No substitution will be permitted except in the sole discretion of GreenChoice Bank, which reserves the right to substitute a prize (or portion thereof) with one of comparable or greater value. All federal, state and local taxes and any other costs and expenses associated with winning a prize are the sole responsibility of Potential Winners. Potential Winners should consult their tax advisors with regard to tax liability. Limit one Potential Winner per person and per household.
6. Winner Notification
The Potential Winners will be notified on or about September 12, 2011 and will be required to execute an Affidavit of Eligibility and Liability Release, Internal Revenue Service Form W-9 and Publicity Release authorizing the public use of the Potential Winner’s name and photo (to be provided by the Potential Winner at GreenChoice Bank's request), all of which must be returned within seven days or the prize may be forfeited and, at GreenChoice Bank's discretion, awarded to an alternate Potential Winner. In the event of noncompliance with the Official Rules, if the prize or prize notification is unclaimed or returned as undeliverable, if all required documents are not returned within the specified time period or if GreenChoice Bank is unable to contact a potential winner within a reasonable time period, the prize may be forfeited and, at GreenChoice Bank's discretion, awarded to an alternate Potential Winner. Alternate Potential Winners will be drawn and notified in the same manner as the original Potential Winners.
7. Limitation of Liability
By participating, entrants agree to: (a) comply with the Official Rules and the decisions of the Sweepstakes Judges and GreenChoice Bank, which shall be final and binding in all respects; and (b) release, discharge, and hold harmless GreenChoice Bank and its parent, subsidiaries, affiliates and advertising and promotion agencies, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies, and each of the respective officers, directors, shareholders, agents and employees of the aforementioned entities (collectively, the "Releasees"), from any liability, claims, costs or damages arising, in whole or in part, directly or indirectly, out of their participation in the Sweepstakes or the acceptance or use of a prize. By accepting a prize, each Potential Winner agrees to GreenChoice Bank's and its designees' use of his/her name, city and state of residence, the fact that he/she is a customer of GreenChoice Bank, and/or likeness for advertising and publicity purposes in any and all media now or hereafter known throughout the world in perpetuity without additional compensation, permission or notification and, upon request, will provide consent to such use in writing. As a condition of entering the Sweepstakes, entrants agree as follows: (i) under no circumstances will an entrant be permitted to claim or obtain an award for special, punitive, incidental, consequential or any similar damages; (ii) all causes of action arising out of or connected with the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action; and (iii) an entrant shall not be entitled to an award or receive attorneys' fees or other legal costs. GreenChoice Bank reserves the right to modify prize award procedures in its discretion. GreenChoice Bank makes no representations or warranties, written, verbal or implied, with respect to the prizes.
8. Additional Terms
Releasees are not responsible for computer, network, printing, typographical, human or other errors, problems or other malfunctions relating to or in connection with the Sweepstakes, including, without limitation, the following: (a) errors, problems or malfunctions which may occur in connection with the administration of the Sweepstakes, the announcement of the prizes, the processing of entries, or in any Sweepstakes-related materials; or (b) stolen, lost, late, misdirected, undelivered, damaged, inaccurate, delayed, incomplete or illegible entries. If, for any reason, this Sweepstakes is not capable of running as planned, or if infection by computer viruses, bugs or tampering, unauthorized intervention, fraud, actions of entrants, technical failures or any other causes corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, or in any event or circumstances, GreenChoice Bank reserves the right in its sole discretion to cancel, terminate, modify or suspend the sweepstakes and, if cancelled or terminated, in its sole discretion, to randomly award (or not award) the prizes from among all eligible non-suspect entries received prior to the action requiring such modification. GreenChoice Bank reserves the right in its sole discretion to disqualify any entry or entrant who tampers with or abuses any aspect of the Sweepstakes or who is in violation of the Official Rules, as determined by GreenChoice Bank in its sole discretion. By entering, all entrants agree that all issues and questions concerning the construction, validity, interpretation and enforceability of the Official Rules, entrants’ rights and obligations or the rights and obligations of the GreenChoice Bank in connection with the Sweepstakes, shall be governed by and construed in accordance with, the laws of State of Illinois, without giving effect to any choice of law or conflict of law rules. By entering, entrants consent to the jurisdiction and venue of the federal, state and local courts located in Chicago, Illinois.
9. Winners' List
To request a list of the names of the winners, mail a self-addressed, stamped envelope to: GreenChoice Bank, Growing Green Sweepstakes, 2545 W. Diversey, #106, Chicago, Illinois, 60647. Requests must be received no later than September 30, 2011. The list will be sent when the final drawing has been conducted and all winners have been verified (no earlier than October 7, 2011).
NO PURCHASE IS NECESSARY TO ENTER. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING.
The Growing Green Sweepstakes is sponsored by GreenChoice Bank, 2545 W. Diversey Ave., #106, Chicago, Illinois 60657. Grand prize: Custom-made sustainably-built table by Demeter Millwork, which includes labor and materials up to a maximum 25 square foot table top area (retail value $1,500). Second prize: Home energy audit by Sylvan Energy Consulting, for a single family residence of 4,000 square feet or less (retail value $750). Third prize: Choice of a one-year individual regular membership to the U.S. Green Building Council, Illinois Chapter or a $100 credit for I GO Car Sharing (retail value $95 and $100, respectively). Odds of receiving each prize depends upon the number of eligible entries received.
